Ape, LLC (“Grateful Ape,” “we,” “us,” or “our”).

By placing an order or using this Website, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Website or place an order.

1. General

- All orders are subject to product availability and acceptance by Grateful Ape.

- We reserve the right to refuse or cancel any order at any time for any reason, including pricing errors, suspected fraud, or violation of these Terms.

- Prices, product descriptions, and availability are subject to change without notice.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to place an order.

3. Product Information

We strive to display accurate product information, images, and pricing. However, we do not warrant that product descriptions, photographs, or other content are error-free. In the event of an obvious pricing error, we reserve the right to cancel the order and refund any payment.

4. California Proposition 65 Warning

**WARNING: Certain natural ingredients in cacao and other botanicals used in our products may contain trace amounts of substances listed under California Proposition 65.

5. Orders and Payment

- All payments must be made in full at the time of purchase.

- We accept major credit/debit cards and other payment methods displayed at checkout.

- You represent that you are authorized to use the payment method provided.

- Applicable taxes, shipping, and handling fees will be added at checkout.

6. Shipping

- We ship only to addresses within the United States

- Shipping times are estimates only. We are not liable for delays caused by carriers, customs, or force majeure events.

- Risk of loss and title pass to you upon delivery to the shipping carrier.

7. Returns & Refunds

Grateful Ape products are food-grade consumables and perishable in nature. For health, safety, and regulatory reasons, we ONLY accept returns and issue refunds in these two limited circumstances:

a) The product arrived physically damaged during shipping (e.g., broken seal, crushed packaging, leakage).

b) The product is defective due to a manufacturing error (e.g., foreign material, incorrect contents, or expired well before the printed date).

To be eligible for a return under these conditions:
- You must notify us within 7 calendar days of delivery by emailing support@gratefulape.com with your order number, clear photos of the damage/defect, and original packaging.

- The product must be unopened (except as necessary to inspect the defect) and in its original condition.

- Upon approval, we will provide a prepaid return label.

- Replacements or Refunds (including original shipping cost only if the entire order is defective/damaged) will be issued to the original payment method within 10 business days of receiving the returned item.

No refunds or replacements will be issued if these conditions are not met.

8. Limitation of Liability

To the maximum extent permitted by law:

- Grateful Ape, its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of our products.

- Our total liability shall not exceed the amount you paid for the specific product giving rise to the claim.

- Products are sold “as is” with no implied warranties beyond any express manufacturer warranty (if applicable).

9. No Medical Advice

Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements have not been evaluated by the FDA. Consult your healthcare provider before use, especially if pregnant, nursing, or on medication.

10. Intellectual Property

All content on the Website (text, images, logos, trademarks) is owned by or licensed to Grateful Ape and protected by copyright and trademark laws. Unauthorized use is prohibited.

11. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah.
